Amine Baba-Ali, Plaintiff, brings this action against the City of New York, Nadine Haddad Sabbagh, M.D., and Elizabeth J. Loconsolo, 1 alleging the common law tort of malicious prosecution and violations of Plaintiff constitutional rights pursuant to 42 U.S.C. § 1983. Defendants move, pursuant to Rule 12(c) of the Fed.R.Civ.P., for partial judgment on the pleadings, or, in the alternative, to dismiss the Complaint pursuant to 12(b)(6) Fed.R.Civ.P. for failure to state a claim upon which relief can be granted.
