LANE, Justice.

This suit was brought by Janice Triplett against Lynn P. Smith to recover for alleged personal injuries and damages incident thereto. For cause of action plaintiff alleged that on the 10th day of December, 1932, she was a passenger in an automobile which was being operated in an easterly direction on Clinton drive-near the city of Houston, and that, when such automobile was in the vicinity of the Municipal Wharves, an automobile truck and trailer loaded with iron pipe was driven by the agents, servants, and employees of Lynn P. Smith across the path of the car in which she was…
