This is an appeal from an order overruling a motion for a new trial.
The facts, briefly stated, are as follows: Eespondent brought an action against appellants to recover upon two causes of action. The cause was set down for trial at 9 .o’clock on the 30th day of September, 1920. One of the appellants, together with his attorney, left Weiser by train on the evening of September 29, 1920, and reached Pocatello at 3 o’clock on the following morning.
