OPINION OF THE COURT
Memorandum.
Judgment of conviction unanimously modified on the law by vacating the conviction of menacing in the third degree and dismissing said count of the accusatory instrument; as so modified, affirmed.
An order of protection directed defendant to stay away from complainant and to refrain from, inter alia, harassing, menacing and threatening complainant. Despite said order, defendant stood outside of complainant’s home, confronted her and yelled, cursed and threatened complainant.
