I. INTRODUCTION
This is an action brought under Section 502(a)(1)(B) [29 U.S.C. § 1132(a)(1)(B)] of the Employee Retirement Income Security Act of 1974 (“ERISA”), 29 U.S.C. § 1001 et seq. (as amended), by James H. Cooke, a participant in the Lynn Sand Pension Plan (“the Plan”).
