OPINION

O’HARA, Judge.

Carl Henry (“petitioner”) has filed a Petition for Review of the decision of the Unemployment Insurance Appeal Board (“Board”) which determined his date of eligibility to receive unemployment compensation benefits. The respondent, Brandy-wine Construction Co., Inc., “employer”), has moved to dismiss the petition.

Petitioner, employed as a laborer by employer from March to August, 1970, left his job on the advice of his physician while suffering from sacroiliac arthritis. On October 30, 1970, the petitioner applied for unemployment compensation benefits. 19 Del.C. § 3315(1)…
