Plaintiff’s husband, Volney F. Wilcox, met his death on November 29, 1928, through being caught in a gravel slide while in performance of his duties as a superintendent on a road construction contract in Lapeer county upon which defendant Wilcox Brothers, a partnership, was engaged. Wilcox Brothers carried accident insurance with the defendant Southern Surety Company under the employers" liability law.
