Reversing.

S. J. Cockrell was elected and -acted -as sheriff of Breathitt county for a term of four years, beginning the first Monday in January, 1925, and ending December 31, 1929. As such he was collector of the state and county revenues, which included the tax levied by the fiscal court of the county for the purpose of the common schools of the county for the year 1929; he, with the Fidelity & Guaranty Company of Maryland, as his surety, executed bond as required by section 4133, Ky.
