HOGAN, Presiding Judge.
This is an action on a promissory note, executed by the defendant as part of a contract between him and the plaintiff. The trial court has sustained the defendant’s motion for summary judgment, and the plaintiff has appealed. We will consider only those questions necessary to a proper disposition of the appeal.
