DIMOND, Justice.

This litigation arises out of a condemnation action which has been before us previously. The Alaska Housing Authority had filed a complaint and a declaration of taking against appellant, Mary Bridges, and her property in connection with an urban renewal project. After a review of the applicable statutes, we held the Authority did not have the power to use a declaration of taking. 1 In a subsequent decision we directed the trial court to dismiss the action 2 The effect of this was that the land was returned to appellant.
