The appellee brought suit against the appellant in the Union Chancery Court, alleging that he was the owner of the southeast quarter of the southwest quarter and the southwest quarter of section 22, township 17 south, range 14'west, in Union County, Arkansas, and lives on said land as his homestead; that said land has been leased for oil and gas, and there has been more or less prospecting for oil and gas in that neighborhood; that, in the late spring of 1922, the defendant, J.
