McWhorter, Judge:
George W. McVey, Jr., as administrator of the estate of William H. Robinson, brought his action against the Chesapeake & Ohio Railway Company, in the circuit court of Kanawha County, to recover damages for the death of his intestate, who was killed by the defendant’s cars, at Montgomery, on the night of the 10th day of December, 1896. The case was tried before a jury, and a verdict rendered in favor of the plaintiff for two thousand five hundred dollars damages.
