OPINION ON STATE’S PETITION FOR DISCRETIONARY REVIEW

McCORMICK, Judge.

The Court of Appeals of the Eleventh Supreme Judicial District reversed appellant’s conviction after finding fundamental error in the court’s charge. 1 The information alleged the following:
