Appellant was charged by affidavit before a justice of the peace of Madison county, with the crime of violating the game laws, in that he hunted and killed squirrels in Madison county during the closed season for hunting 'and killing of such game. He was tried and convicted before the justice of the peace, and sentenced to pay a fine of ten dollars and costs of the prosecution, which included fees of the justice of the peace. Prom that judgment, he appealed to the circuit court of Madison county, where there was a trial de novo.
