Appeal from a judgment of the County Court of Columbia County (Czajka, J.), rendered March 2, 2005, convicting defendant upon his plea of guilty of the crime of criminal possession of stolen property in the fourth degree.

Defendant waived indictment and agreed to be prosecuted by a superior court information charging him with criminal possession of stolen property in the fourth degree. He pleaded guilty to this charge and waived his right to appeal. The prosecution and defense made a joint recommendation that defendant, who had a prior felony, should be sentenced to IV2 to 3 years in prison.…
