MEMORANDUM OPINION AND ORDER

DAVIS, District Judge.

This matter is before the Court upon the motion of Defendant for summary judgment.

In 1993, Plaintiff was an independent financial consultant for Capello Capital Group (CCG). In the summer of 1993, Plaintiff was introduced to Brian Luborsky, the principal owner of Magicuts, Inc., when Luborsky approached CCG for assistance in expanding the number of Magicuts salons. Plaintiff, as a financial consultant with CCG, assisted Magicuts in the purchase of another company, MEI Diversified, Inc., (MEI), which was in Chapter 11 bankruptcy. After MEI was…
