Combined Insurance Company of America (“Combined”) filed this diversity action against one of its former employees, Bernard P. Wiest, Jr., asserting claims for breach of contract, tortious interference with contractual and/or prospective business relations, breach of fiduciary duties, misappropriation of trade secrets, and conversion. The case is presently before the court on the defendant’s motion to dismiss under Rules 12(b)(1) and 12(b)(6) of the Federal Rules of Civil Procedure.
