Briefly summarized, the essential facts of this controversy are as follows: The cashier of a bank organized under the laws of this state was allowed the sole charge and conduct of its affairs by its board of directors. He was indebted individually to a depositor of the bank, and on different occasions *259pretended to make payments upon such indebtedness by giving the depositor credit upon her pass-book.
