WALKER, Chief Justice.
In the lower court, appellee, S. P. Johnson, was plaintiff, and appellants, C. R. Vincent and Carl Kirkwood, were defendants. For cause of action appellee alleged: (1) On the 30th day of November, 1936, appellee and A. S. Sallas were driving a hoopee — an old Model T truck, belonging to appellee, Sallas at the wheel — in a southerly direction, on the right-hand side of Highway No. 35 in Montgomery County.
