MEMORANDUM OPINION AND ORDER

I.INTRODUCTION
Plaintiff Natilia Denise Phillips (hereinafter “Phillips”) brings suit against her former employer Hibbett Sporting Goods, Inc (hereinafter “Hibbett”). Phillips alleges that Hibbett discriminated against her on the basis of her race and sex when it failed to promote her to an Assistant Manager position. Phillips further alleges that when she complained about the alleged discrimination against her, Hibbett terminated her employment in retaliation against her for complaining about discrimination.
