The plaintiff Mark David Niles was, in 1981, a student at Stratford Senior High School in the Springbranch, Texas, Independent School District. As a student, Niles participated in various activities, including intervarsity high school football and track. In the fall of 1981 Niles’s mother, who had divorced in 1971 and who had been awarded custody of Niles, remarried and moved to California.
