CHAPMAN, J.:

On September 10, 1940, Sidney Gurr, the petitioner, was informed against in the Criminal Court of Record of Hillsborough County, Florida, in four counts, for practicing dentistry without first having obtained a certificate from the Florida State Board of Dental Examiners, contrary to the several provisions of Chapter 14708, Acts of 1931, Laws of Florida. Counts two, three and four were withdrawn from the jury and the issues submitted under the first count.
