Plaintiff as special administratrix of the estate of her deceased husband, Thomas C. Donahue, brought this action under the federal employers liability act to recover damages for his death, alleged to have been caused by the negligence of defendant, and obtained a verdict. Defendant moved for judgment notwithstanding the verdict without asldng for a new trial. The motion was denied and judgment entered. Defendant appealed therefrom.
