Action was brought by plaintiff, and appellee, against defendant, and appellant, to recover damages sustained by the plaintiff in an automobile accident which occurred on March 7, 1918, near or at the intersection of Western avenue and Twenty-third street in Chicago. Plaintiff alleges he was struck and knocked down by the automobile in question, of which defendant was the owner and which was being driven and operated by the servant or agent of the defendant. There was a trial before the court and jury resulting in a verdict and judgment for $2,500 in favor of the plaintiff. A reversal of that…
