OPINION OF THE COURT

FREEDMAN, Circuit Judge:

The district court held an evidentiary hearing at which petitioner was repre sented by counsel and denied his petition for a writ of habeas corpus attacking his conviction and sentence to imprisonment for second degree murder entered after a plea of guilty.

Two issues are raised by the appeal. One is that petitioner’s plea of guilty to murder was not knowingly and intelligently entered. The other is that he was deprived of his right of appeal by the default of his counsel.
