This is an appeal from an order sustaining plaintiff’s motion for a new trial after verdict in favor of defendants in a suit filed by respondent, as plaintiff, on a claim against a failed bank whose assets and affairs are in charge of the Commissioner of Finance for liquidation. The parties will be referred to as they were styled in the trial court. The appeal was heard by the Kansas City Court of Appeals, where the action of the trial court was affirmed. [135 S. W.
