Action to contest the alleged will of Hugh W. Thomasson, deceased. The verdict sustained the will. Motion for new trial was overruled and contestants appealed.
Testator had no lineal descendants, and contestants are his collateral kin (on his mother's side), second and third cousins, except Henry S. Bolles and Addison Wellborn. These two were not related to testator, but were made parties plaintiff because they were named as beneficiaries under the will.
