On September 25, 1929, at about 10:30 p. m., standard time (31:30 p. m. daylight -saving time), Michael Whalen, fifty-six years of age, was walking across Penn Avenue, Pittsburgh, from the north to the south side of the street at a point about 125 feet east of the intersection of Penn Avenue and 28th Street. Penn Avenue is a one-way street and for westbound traffic only, although it has two sets of street car tracks.
