Before me is defendants’ motion to dismiss Counts 1-8, 11 and 12. On July 11, 2000, I held oral argument on defendants’ motion. The motion will be granted in part and denied in part.
I. Introduction
Plaintiffs, the Raymond Proffitt Foundation and the Lehigh Stocking Association, a non-profit conservation group and a nonprofit fishing association, respectively, bring this action against defendants, the U.S. Army Corps of Engineers and Lt.
