TAVARES, District Judge.

Plaintiffs seek a review of a workmen’s compensation award granted by defendant Deputy Commissioner of Labor, pursuant to the Longshoremen’s and Harbor Workers’ Compensation Act. Defendant moves to dismiss the complaint on the ground that it was not timely filed.

Section 21(a) of the Act, 33 U.S.C. 921 (a), provides:

“A compensation order shall become effective when filed in the office of the deputy commissioner as provided in section 19, and, unless proceedings for the suspension or setting aside of such order are instituted as provided in subdivision (b) of this…
