*342On April 25, 1904, the Louisville Property Company leased to S. A. Wender and Morris Wender, for a term of 25 years, the exclusive right to mine and remove coal from a tract of land lying in- Whitley county, Ky., containing 89 acres. The lease was duly recorded in the county clerk’s office, and on November 4,1905, was assigned by the lessees to the Wender Blue Gem Coal Company, on condition that it abide by and perform all the conditions and stipulations of the lease.
