• Appeal by the plaintiff, Lizzie Sínica, from a judgment of the Supreme Court in favor of the defendant, entered in the office of the clerk of the county of New York on the 24th day of June, 1918, upon the verdict of a jury, and also from an order entered in said clerk’s office on the 30th day of October, 1918, denying plaintiff’s motion for a new trial made upon the minutes.

This action was brought to recover damages for personal injuries sustained by the plaintiff on January 21, 1917, while •a passenger in an automobile which collided with a crosstown street car operated by the defendant company, al the intersection of Fifth avenue and Eighty-fifth street, in the borough of Manhattan. The plaintiff, with several companions, was returning by automobile from a church wedding and was being driven down Fifth avenue, and in crossing Eighty-fifth street, through which the defendant’s trolley line runs, the automobile in which plaintiff was riding collided…
