delivered the opinion of the court:
Eliza Spear died testate in the county of Santa Clara, in ’ the State of California, in July, 1891. Her will contains twenty-six numbered paragraphs. The first directs that the body be taken to .the State of Illinois for interment. The next twenty-four paragraphs, except paragraphs 14 and 16, gave to legatees therein named sums of money differing in amounts to the different persons mentioned in the various paragraphs.
