Elizabeth Tyree was a paid graduate student intern at the John A. Volpe National Transportation System Center1 (“Volpe Center”). During her internship, Tyree began conducting research for her master’s thesis. After her internship ended, she sought access to the Volpe Center’s proprietary data through a Cooperative Research and Development Agreement (“CRADA”) — an agreement between a federal laboratory and a non-federal entity to share resources and conduct research as defined in 15 U.S.C. § 3710a(d)(l)2 — to continue her thesis, *38but the CRADA was never executed.
