I. INTRODUCTION

Under the Lacey Act, 16 U.S.C. §§ 3371-3378, Congress has provided for federal criminal penalties premised upon the violation of various state, tribal, foreign and federal fish and wildlife protection laws. It is, for example, a federal crime to knowingly sell or purchase, in interstate commerce, fish or wildlife that has been taken “in violation of any law or regulation of any State,” 16 U.S.C. § 3372(a)(2)(A).
