Appeal from Crittenden Circuit Court; W. J. Lamb, Special Judge; 1. It was held on former appeal, reported in 74 Ark. p. 488, that plaintiff’s title rested on a parol gift, perfected by possession and improvements for more than seven years, and that if those allegations were true plaintiff had legal title. The first appeal in this case is reported in 74 Ark. 484 under the style of Brown v. Norvell, and reference Is made to that decision for a statement of the case. In accordance with the mandate the case was transferred to the circuit court, where it proceeded as an action of ejectment. The case was by agreement tried before the court sitting as a jury upon the record made on the first appeal.
