Plaintiff Vicki S. Hensler filed a two-count complaint alleging defendant Busey Bank misapplied the proceeds of a life insurance policy to various notes between defendant and Downtown Electric, Inc., an Illinois corporation. Defendant filed a motion to dismiss plaintiff’s complaint for failure to state a cause of action (Ill. Rev. Stat. 1989, ch. 110, par. 2 — 615(a)) for either breach of contract or breach of a fiduciary duty, which the trial court granted on November 13, 1991.
