Appeal from a judgment of the superior court for Spokane county, Huneke, J., entered June 19, 1917, upon findings in favor of the plaintiff, in an action for a writ of mandate, tried to the court.

The appellant has been operating, since 1905, a telephone system in the city of Spokane. The franchise granted it provided that the charge for telephones installed, in private residences should not exceed $2.25, with a discount of twenty-five cents per month for cash payments made before the 10th day of the month in which the service is rendered. For the sake of brevity we will refer to this as the $2 rate.
