It is not denied that the declaration sets out a- good cause of action. It alleges that the defendant was possessed of and operated a certain railway, by means of which it became and *474was a common carrier of goods and chattels thereon' for hire, from the city of Chicago, in the State of Illinois, to the city of Council Bluffs, in the State of Iowa, and that, as such, it was its duty to carry from and to all stations upon its line of railway all goods and merchandise that might be intrusted to it for that purpose.
