Cyndy Zamora (“Zamora”) timely filed a wrongful termination suit against her state government employer, the Tarrant County Hospital District (“the Hospital”), ten days before the jurisdictional filing deadline set by Tex. Lab. Code Ann. § 21.254 (West 2015) expired. However, her attorney failed to serve the Hospital with citation until twenty-eight days after that deadline expired because the district clerk letter containing citation got lost in the shuffle at his office in the days leading up to his Christmas vacation.
