MOORE, Judge.

Waters Brothers Contractors, Inc. (“the employer”), appeals from a judgment entered by the Lawrence Circuit Court (“the trial court”) awarding George Wimberley (“the employee”) permanent-total-disability benefits. We affirm.

Procedural History

On February 23, 2005, the employee filed a verified complaint seeking workers’ compensation benefits on account of an injury to his left shoulder allegedly caused by an accident arising out of and in the course of his employment with the employer on February 22, 2002.
