Before the court is defendant, Little Caesar Enterprises, Inc.’s (“LCE”) motion for summary judgment, pursuant to Federal Rule of Civil Procedure 56. The motion was initially filed on December 12, 1996 and seeks summary judgment as to all counts of plaintiffs’, Kevin R. Cook and K.
