Motion Nos. 31 and 55 of July 16, 1980 are hereby consolidated and considered together. In this action to recover the proceeds of a life insurance policy, plaintiff moves to dismiss defendant’s affirmative defense and counterclaim which are grounded on the assertion that plaintiff violated “the contractual waiver provision contained intKe~ [p]olicy by obstructing and frustrating defendant’s attempt to conduct a claims investigation”.
