Appellant sought to recover damages against appellee, a hanking corporation. having its main office and principal place of business in Tempje, Bell county, Tex., alleged to have arisen on account of a criminal prosecution against appellant brought by ap-pellee in Bell county, through an affidavit made by E. E. Black, cashier of said bank, before a justice of the peace in said Bell county.
