Error to superior court of Grand Rapids; Dunham, J. Fred C. Rice was convicted, of obtaining money by false pretenses, and sentenced to imprisonment for not less than 4 nor more than 15 years in the State prison at Jackson.

The Excelsior Wrapper Company, hereafter called “the company,” is a Michigan corporation located at Grand Rapids, and is engaged in manufacturing excelsior, excelsior wrapping pads, etc. In the year 1913 it entered into business relations with Fred C. Rice, the defendant, who resided at Traverse City. Stated briefly, the arrangements were that the company agreed to purchase of Rice poplar and basswood bolts at an agreed price; the company was to advance to Rice $5 pet cord on the bolts when and as he advised it he hacl purchased the same, or, as stated by some of the testimony, as he had the…
