In this accounting proceeding a question of construction arises as a result of the exercise by the decedent’s widow of her right to take as against the provisions of the will.

The testator died June 13, 1937, leaving a will, dated July 24, 1935, which -was probated and upon which letters testamentary were issued to the Marine Midland Trust Company of New York, as executor. The testator was in the insurance business and owner of a corporation known as the Michael Levy Company, Inc. He was also the owner of a corporation known as Linroad Realty Corporation.
