OPINION OF THE COURT

HASTIE, Chief Judge.

This is an appeal from the denial, without a hearing, of a motion, brought under section 2255 of title 28, United States Code, to vacate a sentence allegedly imposed in violation of appellant’s constitutional rights.

Appellant Gallarelli was sentenced to three years imprisonment upon his plea of guilty to one count of an indictment charging him with conspiracy in violation of section 371 of title 18, United States Code.1 In his motion to vacate the sentence, he alleged that his Sixth Amendment rights had been violated in that he was not represented by…
