This matter is before the court on the motion for summary judgment of defendant Mercury Marine (“Mercury”) on plaintiff’s complaint (Doc. #73), and defendant .Mercury’s motion for summary judgment on defendant Holiday Mansion’s cross-claim (Doc. # 124). After careful consideration of the parties’ briefs and evidentiary materials, the court is prepared to rule.
