This is a suit to enforce a lien under the Attorney’s Lien Act. A motion to dismiss the plaintiff’s second amended complaint was sustained and plaintiff appeals from a judgment entered in favor of defendant.

Plaintiff’s second amended complaint alleged that James A. Brennan entered into a contract with plaintiff on August 7, 1958, retaining him to prosecute a cause of action against defendant for personal injuries in return for one-third of any amount recovered. Plaintiff notified defendant of the terms of this contract by ordinary mail, claiming an attorney’s lien, and thereafter filed suit…
