In an action to recover damages, alleged to have been caused by misrepresentations by appellant as to the location of the easterly boundary line of real property purchased by respondents from appellant, the appeal is from an order of the County Court, Westchester County, denying appellant’s motion to dismiss the complaint for insufficiency, pursuant to rule 106 of the Rules of Civil Practice. Order reversed, with $10 costs and disbursements, and motion to dismiss granted, with $10 costs. Respondents purchased property described in the contract of sale and presumably in the deed by lot numbers…
